This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information when you submit an application, communicate with us, or engage with our services. Please read this policy carefully. By submitting an application or otherwise providing us with your personal information, you agree to the terms of this Privacy Policy.

INFORMATION WE COLLECT

We collect information you provide directly to us, including:

  • Identity Information: Full name, date of birth, government-issued ID details
  • Contact Information: Phone number, email address, mailing address, city, and state
  • Application Information: Years of experience, prior employment, sales history, leadership background, written responses, and video submissions
  • Financial Information: Bank name, routing number, and account number for direct deposit setup (collected during onboarding, not during application)
  • Background Check Information: Social Security Number and consent to background screening (collected during onboarding)
  • Communication Preferences: Your consent to receive SMS, calls, and emails from RIVAL Sales Group
  • Device & Usage Data: IP address, browser type, pages visited, and timestamp data collected automatically when you access our forms or website

HOW WE USE YOUR INFORMATION

We use the information we collect for the following purposes:

  • To review and evaluate your application for a sales contractor position
  • To communicate with you regarding your application status, next steps, and scheduling
  • To onboard approved applicants, including background check processing and direct deposit setup
  • To send operational communications, training materials, and updates relevant to your engagement with RIVAL
  • To send promotional messages about opportunities, incentive programs, and events at RIVAL Sales Group
  • To comply with applicable legal obligations and enforce our contractor agreements
  • To improve our application process and internal operations

COMMUNICATIONS & SMS CONSENT
SMS / Text Message Program By providing your phone number and checking the consent box on our application form, you expressly consent to receive text messages (SMS/MMS) from RIVAL Sales Group. Message and data rates may apply. Message frequency varies. Reply STOP at any time to opt out. Reply HELP for assistance.

When you provide your phone number and consent to communications, you agree to receive the following types of contact from RIVAL Sales Group and its authorized representatives:

  • SMS/Text Messages: Application updates, scheduling confirmations, onboarding instructions, operational notifications, and promotional messages
  • Phone Calls: Follow-up calls related to your application, interviews, and onboarding, which may use automated or prerecorded technology
  • Email: Application status updates, offer letters, contractor agreements, training materials, and company announcements

Opting Out: You may withdraw your consent to receive text messages at any time by replying STOP to any text message from us. To opt out of email communications, click the unsubscribe link in any email or contact us directly. Opting out of marketing communications will not affect transactional communications necessary to fulfill your contractual obligations with RIVAL Sales Group.

Consent is Not a Condition: Your consent to receive communications is not a condition of employment, engagement, or any other benefit from RIVAL Sales Group. Declining to consent will not affect your application review.

HOW WE SHARE YOUR INFORMATION

We do not sell your personal information. We may share your information with the following categories of parties:

  • Master Dealer / ISP Partners: We work with authorized dealer networks and internet service providers (such as Comcast/Xfinity through Alchemy Enterprises) who require contractor information for credentialing and compliance purposes
  • Background Check Providers: We share necessary information with third-party background screening services as required for contractor credentialing
  • Service Providers: We use third-party tools (including cloud storage, form processing, and communication platforms) that may process your data on our behalf under confidentiality agreements
  • Legal Requirements: We may disclose your information when required by law, court order, or governmental authority, or when necessary to protect the rights and safety of RIVAL Sales Group and its contractors

All third parties who receive your personal information are contractually obligated to protect it and use it only for the purposes for which it was shared.

DATA RETENTION

We retain your personal information for as long as necessary to fulfill the purposes described in this policy or as required by law:

  • Applications (not selected): Retained for up to 12 months from the date of submission, after which they are deleted or anonymized
  • Active Contractor Records: Retained for the duration of your engagement with RIVAL Sales Group plus 3 years following termination
  • Financial Records: Retained for 7 years in accordance with applicable tax and accounting requirements
  • Communication Consent Records: Retained indefinitely as required to demonstrate consent compliance

YOUR RIGHTS & OPT-OUT

Depending on your state of residence, you may have certain rights regarding your personal information, including:

  • Access: The right to request a copy of the personal information we hold about you
  • Correction: The right to request correction of inaccurate or incomplete information
  • Deletion: The right to request deletion of your personal information, subject to legal retention requirements
  • Opt-Out of Communications: The right to opt out of marketing communications at any time (see Section 3)
  • Non-Discrimination: We will not discriminate against you for exercising your privacy rights

To exercise any of these rights, contact us using the information in Section 11. We will respond to verified requests within 30 days.

Florida Residents Florida residents have specific rights under the Florida Digital Bill of Rights (FDBR) effective July 1, 2024. If you are a Florida resident, you may exercise your rights by submitting a request to [email protected].

DATA SECURITY

We implement reasonable administrative, technical, and physical safeguards to protect your personal information from unauthorized access, use, or disclosure. These measures include encrypted data transmission, access controls, and secure cloud storage through industry-standard platforms.

However, no method of transmission over the internet or electronic storage is 100% secure. While we strive to protect your personal information, we cannot guarantee absolute security. In the event of a data breach that affects your rights or freedoms, we will notify you as required by applicable law.

We encourage you not to share sensitive information (such as banking details) through channels other than our secure onboarding form.

THIRD-PARTY SERVICES

Our application process and operations rely on the following categories of third-party services, each with their own privacy practices:

  • Cloud Video Storage (Cloudinary): Used to securely store video submissions uploaded through our application form
  • Data Storage (Google Workspace): Application data and deal records are stored in Google Sheets and associated Google services
  • Background Check Services: Third-party credentialing and screening providers used for contractor verification
  • Communication Platforms: SMS, email, and phone communication tools used to contact applicants and contractors
  • Web Hosting (Netlify): Our application forms are hosted on Netlify's infrastructure

We encourage you to review the privacy policies of any third-party services you interact with through our platforms.

CHILDREN'S PRIVACY

Our services are intended for individuals who are 18 years of age or older. We do not knowingly collect personal information from individuals under the age of 18. If we become aware that we have inadvertently collected personal information from a minor, we will take steps to delete that information promptly. If you believe a minor has submitted information to us, please contact us immediately at the address listed in Section 11.

CHANGES TO THIS POLICY

We may update this Privacy Policy from time to time to reflect changes in our practices, legal requirements, or operational needs. When we make material changes, we will update the "Last Updated" date at the top of this page. We encourage you to review this policy periodically. Your continued interaction with RIVAL Sales Group following the posting of changes constitutes your acceptance of the updated policy.

For significant changes that affect how we use your personal information, we will make reasonable efforts to notify you directly, such as by email or a prominent notice on our application form.
